How do you plan for the unexpected?

But think about it.

We do that every day and our regular

lives. Insurance is really

the best example of planning

for the unexpected.

We buy health care insurance,
00:01:14:22 00:01:16:12
car insurance, homeowner's
00:01:16:13 00:01:17:09
insurance.
00:01:17:10 00:01:18:21
We buy these things because we

know that it's possible that we're
00:01:21:09 00:01:23:06
going to need health care.
00:01:23:15 00:01:25:03
We know that it's possible we're
00:01:25:04 00:01:26:11
going to get in a car accident.
00:01:26:12 00:01:27:25
We know it's possible our house is
00:01:27:26 00:01:28:25
going to burn down.
00:01:29:04 00:01:30:06
We know that those things are
00:01:30:07 00:01:32:14
possible, not likely, but possible.

But one thing that is much more
00:01:34:15 00:01:36:06
possible than anything
00:01:36:11 00:01:38:03
is a health care crisis.

Now, one of the things I want to

make clear is that

you can't go around thinking like
00:01:45:11 00:01:47:06
almost everybody does.
00:01:47:07 00:01:48:24
We all think this way.
00:01:49:03 00:01:50:03
And I have been
00:01:51:04 00:01:52:20
one of those people as well, that
00:01:52:21 00:01:54:13
it's not going to happen to us
00:01:54:19 00:01:55:20
or at least that it's not going to
00:01:55:21 00:01:57:12
happen to us while we're young,
00:01:57:23 00:01:58:23
because unexpected
00:02:00:04 00:02:01:23
health care crisis is our unexpected
00:02:02:01 00:02:03:18
events happen to young people
00:02:04:03 00:02:05:18
every single day.
00:02:06:03 00:02:07:21
Now, think about the people in your
00:02:07:22 00:02:09:12
life and you know what I'm saying?
00:02:09:21 00:02:12:03
We all know people that were
00:02:12:04 00:02:14:23
young, had cancer
00:02:15:02 00:02:16:21
and got in a car accident.
00:02:17:04 00:02:18:10
Something happened to them.
00:02:18:11 00:02:20:09
We all know people like that.
00:02:20:17 00:02:22:04
And there's not a lot of those
00:02:22:05 00:02:24:07
people hopefully in our lives, but
00:02:24:08 00:02:25:09
they exist.
00:02:26:03 00:02:27:10
So and then, of course, as
00:02:28:01 00:02:29:01
we age, those
00:02:30:00 00:02:31:12
things happen with increasingly
00:02:31:16 00:02:32:25
increasing frequency.
00:02:33:08 00:02:34:11
Heart attacks, strokes,
00:02:35:05 00:02:37:06
cancers, different types
00:02:37:07 00:02:38:16
of things happen to us as we age.
00:02:38:17 00:02:40:05
And it just becomes increasingly
00:02:40:15 00:02:42:10
likely as we get older that
00:02:42:11 00:02:43:16
we're going to have a health care
00:02:43:17 00:02:44:16
crisis.
00:02:44:19 00:02:45:23
That being said,
00:02:46:19 00:02:48:14
it's definitely still possible while
00:02:48:15 00:02:49:09
we're young.
00:02:49:10 00:02:50:11
And I want to tell you
00:02:51:08 00:02:53:00
a little personal thing about this,
00:02:53:09 00:02:55:12
just to make it very clear how
00:02:55:13 00:02:57:02
likely this is or how possible it
00:02:57:04 00:02:59:02
is. You know, I'm a lawyer
00:02:59:06 00:03:00:21
and not only am I a lawyer, I'm a
00:03:00:23 00:03:02:18
lawyer that deals with this exact
00:03:02:19 00:03:04:12
topic every single day.
00:03:04:24 00:03:06:06
I deal with helping people
00:03:07:01 00:03:08:02
prepare for unexpected
00:03:09:05 00:03:10:05
events.
00:03:10:20 00:03:11:20
And, you know, we do
00:03:12:19 00:03:14:25
estate planning. We do life planning
00:03:15:00 00:03:16:00
in my office.
00:03:16:01 00:03:17:15
And this is the type of thing that

we do.

But even though I intellectually
00:03:21:20 00:03:23:15
know and knew that
00:03:23:18 00:03:25:15
it could happen to me as well,
00:03:25:19 00:03:27:12
I didn't really think it would
00:03:27:16 00:03:28:23
just like everybody else.
00:03:29:03 00:03:30:23
Because to be honest with you,
00:03:31:02 00:03:32:23
I'm definitely on the healthier
00:03:32:24 00:03:33:21
side, or I would have been
00:03:33:22 00:03:35:23
considered to be on the healthier
00:03:35:24 00:03:37:23
side of the spectrum of somebody
00:03:37:24 00:03:38:23
my age.
00:03:39:16 00:03:40:18
But in January of this
00:03:41:12 00:03:42:12
year, I had I
00:03:43:10 00:03:45:10
got diagnosed with a very rare
00:03:45:11 00:03:46:10
disease called
00:03:46:16 00:03:47:16
Lymphangioleiomyomatosis.
00:03:48:23 00:03:50:19
Now, this is a very
00:03:50:20 00:03:52:12
rare lung disease that
00:03:52:23 00:03:55:02
in my particular type of case
00:03:55:10 00:03:56:24
is a genetic.
00:03:57:16 00:03:58:22
They think there's a triggering
00:03:58:23 00:03:59:17
genetic event.
00:03:59:18 00:04:00:21
So it's not even something that
00:04:00:22 00:04:02:10
you're necessarily born with.
00:04:02:16 00:04:04:05
It just sort of happens to you.
00:04:04:12 00:04:05:24
And I just happen to be the one of
00:04:06:00 00:04:07:13
the people that happens to.
00:04:07:20 00:04:09:16
Now, I look healthy now.
00:04:09:17 00:04:11:01
I hope at least I do.
00:04:11:09 00:04:13:06
But I can tell you that I
00:04:13:07 00:04:14:20
was in the hospital twenty seven
00:04:15:17 00:04:17:22
days this year and
00:04:17:23 00:04:20:02
it is June while I'm recording
00:04:20:03 00:04:21:17
this. And this happened in January.
00:04:22:03 00:04:23:23
And so I'm telling
00:04:23:24 00:04:25:13
you this because I didn't expect
00:04:25:20 00:04:26:24
this to happen to me.
00:04:27:04 00:04:28:05
I didn't expect to be in the
00:04:28:06 00:04:29:14
hospital. Twenty seven days.
00:04:29:17 00:04:31:06
I didn't expect to get diagnosed
00:04:31:19 00:04:33:16
with this crazy, rare disease.
00:04:34:04 00:04:35:12
I didn't expect any of that.
00:04:35:13 00:04:36:20
But it happened to me.
00:04:37:13 00:04:38:13
And even though this
00:04:39:12 00:04:40:18
is something that I deal with every
00:04:40:19 00:04:41:19
single day, I wasn't
00:04:42:15 00:04:44:05
as fully prepared as I could have
00:04:44:12 00:04:45:19
been. Now, I think I was much more
00:04:45:20 00:04:47:03
prepared than the average person
00:04:47:04 00:04:48:21
made, but I still wasn't as well
00:04:48:22 00:04:49:25
prepared as I could have been.
00:04:50:08 00:04:52:17
So let me just give you a few tips
00:04:52:21 00:04:54:03
about how to prepare.
00:04:54:21 00:04:57:01
And I'm going to very quickly
00:04:57:02 00:04:58:18
talk about the legal ways that you
00:04:58:23 00:04:59:22
should prepare.

But I'm not going to get into depth

about that because I want to get

But this is the two things

that you need to prepare for, for an

that are legal documents.

You absolutely need a

health care power of attorney and

a financial power of attorney.

Absolutely must have these

documents.
00:05:24:00 00:05:25:14
And I know right now that some of
00:05:25:15 00:05:26:21
you are thinking. But I married my
00:05:26:22 00:05:28:06
husband can take care of that.
00:05:28:12 00:05:30:03
My daughter can take care of that.
00:05:30:12 00:05:31:12
No, do not go
00:05:32:08 00:05:34:11
around thinking that you
00:05:34:12 00:05:36:13
can join
00:05:36:14 00:05:38:02
on my account all these kinds of
00:05:38:06 00:05:39:04
things.
00:05:39:05 00:05:41:05
There are so many mistakes
00:05:41:06 00:05:42:16
or things that people assume when it
00:05:42:17 00:05:44:06
comes to their finances and their
00:05:44:07 00:05:45:22
health that they think that people
00:05:45:23 00:05:46:18
are going to be able to.
00:05:46:19 00:05:48:19
Do they can't do legally for
00:05:48:20 00:05:50:17
them and you don't want to know
00:05:50:18 00:05:52:05
that they can't do it when it's too
00:05:52:06 00:05:53:14
late, and so health care and
00:05:54:01 00:05:55:13
financial powers of attorney are
00:05:55:14 00:05:56:24
absolutely necessary.

And I am, like I said, going to get
00:05:58:21 00:06:00:07

what you need to be making sure is

But today, I just want to make

sure you know that that's part of

100 all the way in between,

you need that document because the

moment you become a legal adult,

your parents, your loved
00:06:26:26 00:06:28:05
ones, your spouse doesn't

necessarily have an automatic legal
00:06:30:12 00:06:31:14
right over your stuff.

And so you just want to make sure

that that's being taken care of.

But also, part of

good planning for an unexpected

health care crisis is really

making sure that you have

the right doctor on your team
00:06:46:02 00:06:48:00
and that you have the right
00:06:48:06 00:06:50:11
family member friend.

Other person that is in your
00:06:53:18 00:06:55:20
life that's going to be able
00:06:55:21 00:06:57:23
to help you if something happens,
00:06:58:10 00:06:59:18
and what do I mean by that?
00:06:59:21 00:07:00:25
Because when you're healthy, it's
00:07:00:26 00:07:02:18
really hard to understand where I'm
00:07:02:19 00:07:03:19
coming from.
00:07:05:09 00:07:07:01
But you need to think to yourself,
00:07:07:04 00:07:08:16
if I got hit by a car tomorrow
00:07:09:11 00:07:11:00
and I was in the hospital,
00:07:11:10 00:07:13:02
who is going to be the person
00:07:13:06 00:07:14:25
that I'm going to want by my side
00:07:15:05 00:07:16:15
that's going to be able to talk to
00:07:16:16 00:07:17:22
the doctors is going to be
00:07:18:12 00:07:20:05
able to retain the information?
00:07:20:10 00:07:22:08
Is it going to be freaking out
00:07:22:09 00:07:24:04
the whole time while this is
00:07:24:05 00:07:25:04
happening and is
00:07:25:25 00:07:28:00
going to be able to help make
00:07:28:01 00:07:29:15
the right decisions for me
00:07:30:02 00:07:31:02
now?

Because you know what?

I'm saying this to you because

sometimes we automatically say,
00:07:34:10 00:07:35:20
well, our spouse is the best person
00:07:35:21 00:07:37:19
or, you know, whoever, but
00:07:37:20 00:07:39:04
sometimes especially with health
00:07:39:05 00:07:40:16
care stuff, if somebody is not
00:07:41:06 00:07:42:06
able to be
00:07:43:07 00:07:45:11
really good about understanding
00:07:45:20 00:07:46:20
medical things and or
00:07:47:20 00:07:49:14
being able to challenge a doctor, if
00:07:49:19 00:07:50:17
they're saying things that don't
00:07:50:18 00:07:51:24
seem to be making sense or
00:07:52:14 00:07:54:12
in explaining things well enough
00:07:54:17 00:07:56:03
or are telling you things are
00:07:56:14 00:07:58:03
in conflict with what another doctor
00:07:58:04 00:07:59:21
told you, all these things happen.
00:07:59:22 00:08:00:22
They all happen to me.
00:08:01:19 00:08:03:10
You want to make sure that you have
00:08:03:11 00:08:05:03
somebody that's going to be able
00:08:05:12 00:08:06:16
to stand by you and say,
00:08:07:11 00:08:08:11
wait a minute.
00:08:08:22 00:08:10:02
The other doctor said this.
00:08:10:10 00:08:11:13
That doesn't make sense in the
00:08:11:14 00:08:12:23
context of what you're saying to me.

Explain that again and tell me

why that's necessary.

Or, you know, just be able to
00:08:18:20 00:08:20:11
absorb it and then say to you, hey,

this is what the doctor said, what
00:08:21:18 00:08:23:18
should what do you want to do?

And then you can say, but I thought
00:08:25:04 00:08:26:12
they said there's no this is what
00:08:26:13 00:08:28:03
the doctor said, you know, sort of
00:08:28:04 00:08:29:14
interpret things for you, because
00:08:29:15 00:08:31:18
when you are in a health care crisis
00:08:31:19 00:08:32:19
yourself,
00:08:33:20 00:08:35:09
you are compromised.
00:08:35:10 00:08:37:11
I mean, listen, I
00:08:38:03 00:08:39:04
am highly functioning
00:08:40:12 00:08:42:03
and able to understand things.
00:08:42:04 00:08:43:22
And I deal with medical things every
00:08:43:23 00:08:44:24
day as a lawyer.
00:08:45:06 00:08:46:06
But, you know, when
00:08:47:02 00:08:48:14
you're in the hospital, you're
00:08:48:15 00:08:50:03
having surgeries, they're giving
00:08:50:12 00:08:51:22
you pain pills and all kinds of
00:08:51:23 00:08:52:22
stuff. Your capacity
00:08:53:21 00:08:54:22
is diminished.
00:08:55:01 00:08:56:12
Doesn't matter whether you actually
00:08:56:13 00:08:58:04
are still have legal capacity.
00:08:58:05 00:08:59:17
Most people a lot of people still
00:08:59:18 00:09:01:20
do, but your capacity is diminished.
00:09:01:21 00:09:03:01
You're not able to understand
00:09:03:02 00:09:04:03
especially things that are as
00:09:04:04 00:09:05:19
complex. So you need to have
00:09:06:01 00:09:08:03
a person or persons
00:09:08:09 00:09:10:04
that, you know are going to be the
00:09:10:05 00:09:12:05
right people that are going to be on
00:09:12:06 00:09:13:13
your team in the event that
00:09:14:02 00:09:15:15
you have an unexpected health care
00:09:15:16 00:09:17:14
crisis. And so you want to make sure
00:09:17:15 00:09:18:19
that, you know, those people are
00:09:18:20 00:09:20:11
you've identified them and they're
00:09:20:12 00:09:22:04
also incorporated into your legal
00:09:22:05 00:09:23:04
documents.

The other thing, like I said, is

having the right doctor because

you don't want to do what I noticed

so many of us do.

And I was guilty of this.

And I talked to many, many people

that are very guilty of this.

Is having a primary
00:09:37:25 00:09:39:25
care physician or other doctor
00:09:40:04 00:09:41:19
that does not listen to you,
00:09:42:05 00:09:43:16
does not take your concerns
00:09:43:17 00:09:45:15
seriously, is not willing to
00:09:45:16 00:09:47:01
explain things to you, leaves
00:09:48:02 00:09:50:14
you confused when
00:09:50:22 00:09:52:14
you leave their office
00:09:52:22 00:09:54:18
or doesn't address the
00:09:54:19 00:09:56:17
things that you are feeling are
00:09:56:18 00:09:58:13
crucial to
00:09:58:14 00:09:59:13
your health.
00:09:59:19 00:10:01:13
And this can happen even when you're
00:10:01:16 00:10:03:13
sort of healthy. I mean, if you go
00:10:03:14 00:10:04:21
into the doctor and this is
00:10:05:10 00:10:06:24
an experience I had, I went into
00:10:07:08 00:10:08:25
the doctor and I'm telling this
00:10:09:00 00:10:10:06
doctor that I'm dizzy and
00:10:10:21 00:10:12:19
I'm having, like, all these crazy.
00:10:12:23 00:10:14:04
It was almost like vertigo.
00:10:14:05 00:10:16:01
I felt like I was like going to pass
00:10:16:02 00:10:17:01
out.
00:10:17:02 00:10:18:02
And, you know, it was
00:10:19:02 00:10:21:05
really funny is the doctor
00:10:21:19 00:10:23:08
gave me this Vertigo medication.
00:10:23:15 00:10:24:24
I never ended up taking it,
00:10:25:18 00:10:27:12
but it turned out I was pregnant.
00:10:28:02 00:10:29:02
I was pregnant.
00:10:29:20 00:10:31:04
I never checked me to see if
00:10:31:21 00:10:32:21
I was pregnant.
00:10:33:15 00:10:34:23
You know, stuff like that doesn't
00:10:34:24 00:10:35:23
make a lot of sense.
00:10:36:02 00:10:37:04
And you know what, though?
00:10:37:05 00:10:38:08
This is the worst thing about it.
00:10:38:09 00:10:39:10
And I'm just telling you this
00:10:39:11 00:10:40:15
because you have to understand how
00:10:40:16 00:10:41:22
easy it is for these things to
00:10:41:23 00:10:43:12
happen. I stayed with that doctor
00:10:43:21 00:10:45:11
even after that happened, because
00:10:46:06 00:10:48:03
I sort of chalked it up to I
00:10:48:04 00:10:49:04
don't even know what I chalked it up
00:10:49:05 00:10:50:09
to. You know what I chalked it up to
00:10:50:13 00:10:51:24
convenience. It was convenient for
00:10:52:00 00:10:53:04
me to stay with that doctor.
00:10:53:11 00:10:55:05
But then when I really had a serious
00:10:55:08 00:10:57:01
health care crisis, that doctor was
00:10:57:02 00:10:58:13
absolutely not the right one for me.
00:10:58:19 00:10:59:24
And I very much regretted
00:11:00:14 00:11:02:13
not having sat out the services of
00:11:02:14 00:11:04:12
another doctor prior
00:11:04:16 00:11:06:03
to having this health care crisis,
00:11:06:04 00:11:08:00
because then when I
00:11:08:01 00:11:09:15
needed somebody, I didn't have
00:11:09:16 00:11:10:09
anyone.
00:11:10:10 00:11:12:10
So it's really essential
00:11:12:11 00:11:14:11
to get the right doctor on your team
00:11:14:18 00:11:15:25
and you want to invest the
00:11:16:15 00:11:18:07
time to find that person.
00:11:18:24 00:11:20:19
So this is
00:11:20:22 00:11:22:09
sort of scratching the surface
00:11:22:25 00:11:24:20
of what you can do in times of
00:11:24:21 00:11:26:12
an unexpected health care crisis.
00:11:26:21 00:11:27:24
But I think that if you
00:11:28:22 00:11:30:16
are otherwise healthy person,
00:11:30:20 00:11:32:15
even taking these minor steps,
00:11:33:00 00:11:34:23
trust me when I tell you it
00:11:34:24 00:11:36:25
will take you so much further
00:11:37:06 00:11:38:24
than if you don't
00:11:39:02 00:11:41:05
have any preparation whatsoever.
00:11:41:12 00:11:42:22
The stress on yourself and on
00:11:43:10 00:11:45:03
the other people that you love is
00:11:45:04 00:11:46:06
just not worth it.
00:11:46:09 00:11:47:22
And so you want to at least get
00:11:48:08 00:11:49:21
some of these little things in place
00:11:49:22 00:11:51:03
that are easy to do.
00:11:51:07 00:11:52:22
By the way, they're easy, it may
00:11:52:23 00:11:54:15
sound a little bit daunting, but it
00:11:54:18 00:11:56:13
really is pretty easy to do
00:11:56:21 00:11:57:21
and that is part of
00:11:58:21 00:12:01:03
